In short

## What is SMS compliance?

SMS compliance means texting only people who agreed to hear from you, honoring STOP right away, sending at reasonable hours where the customer lives and registering your number with carriers. SmartyTap checks consent, opt-outs and quiet hours before each text and walks you through 10DLC or toll-free registration.

The problem

One text at 11 p.m. or one message to someone who replied STOP can cost you the customer, a carrier block or worse. Most tools leave the rules to you. SmartyTap checks them before every send, in each customer's own time zone.

## Everything you need to sell more.

### Consent on record

Every opt-in and opt-out is saved with where it came from and when, so you can show who agreed.

### STOP, START and HELP

Opt-out, opt-in and help words get an automatic reply on every number, and opted-out customers don't get your texts.

### Quiet hours by time zone

Texts wait until quiet hours end in each recipient's local time, not yours.

### Double opt-in

Turn on double opt-in, and the consent record keeps when each subscriber confirmed.

### Carrier lookup

Each number is looked up before sending, and its carrier, line type and country are saved with the message.

### 10DLC and toll-free registration

Setup collects your business details and handles toll-free verification and 10DLC brand and campaign registration.

## How it works.

1. 1

    ### Register your number

Pick a toll-free or local number, or bring yours, and complete registration in setup.

2. 2

    ### Collect consent

Forms and keywords record each opt-in with its source and time.

3. 3

    ### Set quiet hours

Choose the hours texts should never arrive. SmartyTap applies them in each recipient's time zone.

4. 4

    ### Send with checks

Every text is checked for consent, opt-outs and quiet hours before it goes out.

## How quiet hours find each time zone.

A Pacific customer and an Eastern customer shouldn't get the same text at the same local hour by accident.

### Saved time zone first

If we know the customer's time zone, quiet hours are counted there.

### Then the phone number

If not, SmartyTap uses the time zones of the phone number, which is one zone for most US area codes.

### Wait out every possible zone

When a number could be in more than one zone, the text waits until it's outside quiet hours in all of them.

### Then your workspace

If the number gives no clue, your workspace time zone is used.

### Per-message switch

Quiet hours are on for every text. You can turn them off for one message, and SmartyTap warns you before it sends.

### Smart Sending, too

Campaign texts skip anyone who got a text from another campaign in the last 24 hours.

## Rules to know before you text.

General information, not legal advice. Rules change and differ by state and country, so check with your lawyer.

### TCPA, 47 CFR § 64.1200(a)(2)

What it says

Marketing calls and texts sent with an autodialer to cell phones need the prior express written consent of the person you're texting.

How SmartyTap helps

Consent records with source and time; only opted-in customers get marketing texts.

### TCPA, 47 CFR § 64.1200(c)(1)

What it says

No telephone solicitations to residential subscribers before 8 a.m. or after 9 p.m., local time at the called party's location.

How SmartyTap helps

Quiet hours counted in each recipient's local time.

### Florida Statutes § 501.616(6)

What it says

No commercial telephone solicitation calls before 8 a.m. or after 8 p.m. in the called person's time zone, and no more than three on the same subject in 24 hours.

## Common questions

### What is SMS compliance?

Texting only people who agreed to hear from you, honoring STOP right away, sending at reasonable hours where the customer lives and registering your number with carriers. SmartyTap checks consent, opt-outs and quiet hours before each text and walks you through 10DLC or toll-free registration.

### What hours can I send marketing texts?

The federal TCPA rule, 47 CFR § 64.1200(c)(1), bars telephone solicitations before 8 a.m. or after 9 p.m. in the recipient's local time, and some states, like Florida, set a narrower window. This is general information, not legal advice. In SmartyTap you set your quiet hours and they apply in each recipient's time zone.

### How does SmartyTap know a customer's time zone?

It uses the customer's saved time zone. If there isn't one, it uses the time zones of their phone number. If the number could be in more than one zone, the text waits until it's outside quiet hours in all of them. If there's no clue at all, it uses your workspace time zone.

### Does SmartyTap handle STOP and HELP?

Yes. STOP, START and HELP get an automatic reply on every number, you write the help and opt-out messages, and customers who opted out are skipped.

### Do I need 10DLC registration?

If you text US customers from a 10-digit local number, carriers expect a registered brand and campaign through The Campaign Registry. Toll-free numbers go through toll-free verification instead. SmartyTap setup handles both.

### Is this legal advice?

No. This page explains how SmartyTap's tools work and names the rules they help with. Laws change and differ by state and country, so check with your lawyer.
